These Terms of Sale apply to all purchases made from Mo’s Music Market. By placing an order, you agree to these terms.

These Terms of Sale should be read alongside our Terms of Service, Delivery Information, Returns & Refunds Policy, and Warranty Policy.

2. Contract Formation

When you place an order, you will receive an order confirmation email. This email is an acknowledgement only and does not constitute acceptance.

A legally binding contract is formed only when:

  • The item is dispatched, and
  • You receive a dispatch confirmation

We reserve the right to cancel or refuse any order prior to dispatch.


3. Product Information

We sell a mix of:

  • New
  • B-stock
  • Pre-owned and vintage musical equipment

We aim to describe all items accurately and honestly. However:

  • Pre-owned items will show signs of use
  • Vintage items may have age-related wear or modifications
  • Original packaging and documentation may not be included unless stated

Minor cosmetic wear and variations should be expected and do not constitute a fault.

If an item is materially not as described, please contact us and we will resolve the issue.


4. Condition & Suitability

All products are sold on the basis that:

  • You have reviewed the description and images carefully
  • You understand the nature of pre-owned and specialist musical equipment
  • Suitability for your intended use is your responsibility

Musical instruments often require personal setup (e.g. string height, tuning stability, tonal preferences). These are not faults.


5. Pricing & Availability

We take care to ensure pricing and listings are accurate, but errors may occur.

If we discover an error, we may:

  • Cancel the order and issue a full refund, or
  • Contact you to confirm whether you wish to proceed at the correct price

We are not obliged to supply goods at an incorrect price.

All items are subject to availability. Many items are one-off and may become unavailable before dispatch.


6. Payment

Payment must be made in full before dispatch.

We accept secure payment methods as shown at checkout.

We reserve the right to refuse or cancel transactions where we suspect fraud or unauthorised activity.


7. Delivery & Risk

Delivery is arranged via third-party couriers.

  • Delivery times are estimates and not guaranteed
  • Risk passes to you once the item is delivered to the address provided
  • It is your responsibility to ensure delivery details are accurate

If delivery fails due to incorrect details or missed delivery attempts, additional charges may apply.


8. Title (Ownership)

Ownership of the goods passes to you once:

  • Full payment has been received, and
  • The goods have been dispatched

9. Right to Cancel (Consumer Contracts Regulations 2013)

If you purchase online, you have the legal right to cancel your order within 14 days of delivery.

You then have a further 14 days to return the item.

To exercise this right:

  • You must notify us within the 14-day period

Refunds will include:

  • The full item price
  • The cost of standard delivery (where applicable)

You are responsible for return shipping costs unless the item is faulty or not as described.

10. Returns Beyond 14 Days

We offer a 30-day returns period for change-of-mind returns.

For returns made after the initial 14-day legal period:

  • Delivery charges are non-refundable
  • All other return conditions still apply

11. Faulty or Not as Described Goods

Your rights are protected under the Consumer Rights Act 2015.

If an item is:

  • Faulty
  • Not as described
  • Not fit for purpose

You may be entitled to:

  • Repair
  • Replacement
  • Refund

Please contact us as soon as possible if you experience any issues.


12. Deductions for Use

You may inspect the goods as you would in a shop.

However, we may make a deduction from your refund if the value of the goods has been reduced due to handling beyond what is necessary to establish their nature, characteristics, and function.


13. Limitation of Liability

Nothing in these terms excludes or limits your legal rights.

To the extent permitted by law:

  • Our liability is limited to the purchase price of the goods
  • We are not liable for indirect or consequential losses, including loss of income, gigs, recordings, or business opportunities

14. Events Outside Our Control

We are not liable for failure or delay in performing our obligations where this is due to events beyond our reasonable control (e.g. courier delays, strikes, severe weather).


15. Governing Law

These Terms of Sale are governed by the laws of Scotland.

Any disputes will be subject to the jurisdiction of the Scottish courts.
